ARTICLE 1: SCOPE AND MODIFICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE
The current general terms and conditions of sale apply to all orders placed on the Eco Creation website. Eco Creation reserves the right to adapt or modify them at any time. In the event of an update, the applicable conditions will be those in force on the date of the order.
ARTICLE 2: PRODUCT AVAILABILITY
Our offers remain valid as long as they are displayed on the site.
For products that are out of stock, the manufacturing lead time is specified on the product sheet, depending on the company’s production schedule. Unless otherwise stated, items in stock are dispatched within a maximum of 10 days, plus the delivery time indicated in article 8 below.
If a product ordered proves to be unavailable after your order has been confirmed, you will be informed by e-mail as soon as we have received this information from our supplier.
You may cancel your order for an unavailable product on request. No compensation other than a full refund of the order may be claimed, as this unavailability is mainly due to stock updating times.
We reserve the right to limit the number of orders of the same product per account.
The characteristics of the products on sale are detailed on their respective data sheets.
All texts and images created by ecocreation.com and published on the site are protected by copyright and intellectual property worldwide. Any reproduction, even partial, is strictly prohibited. The illustrations (photos, visuals) provided by the brands remain the exclusive property of ecocreation.com.
ARTICLE 3: VALIDATION OF ORDERS
There are 4 steps to ordering from ecocreation.com.
- Adding items to the basket.
- Enter your billing and delivery details.
- Choose your mode of transport.
- Access to the payment method selected in your basket.
An order will be considered valid when these 4 steps have been properly completed.
ARTICLE 4 : PRICE
The price is expressed in euros, excluding taxes, transport costs, customs duties, dock dues and customs clearance costs.
ecocreation.com reserves the right to modify its prices at any time but undertakes to apply the current rates indicated at the time of your order.
ARTICLE 5 : SPECIAL OFFERS
Most promotions are applied directly to the original price and are immediately visible in your basket.
ARTICLE 6: PAYMENT METHODS AND SECURITY
ecocreation.com offers 2 payment options:
Payment by CREDIT CARD:
When paying by credit card, you indicate your card number, the date of validity and the number on the back of the card.
Authorisation servers are then consulted in order to check this data and prevent abuse and fraud.
The servers are then in encrypted mode and all the information transmitted is encoded (SSL protocol). Nothing is transmitted unencrypted on the web.
The trick: icons displayed at the bottom of the page indicate that you are on a secure part of the website.
Payment is made using the 3D SECURE protocol, which provides enhanced security for both consumers and retailers.
Payment is then made outright, when the order is placed.
Payment by ADMINISTRATIVE MANDATE
All bank charges are at the customer’s expense. Please remember to quote the order number as a reference.
For customers choosing this method of payment, payment must be made within thirty days of the invoice date, without discount for early payment.
In case of late payment, ecocréation.com may suspend all orders in progress, without prejudice to any other course of action. Invoices not paid by the due date will be increased automatically and without prior notice:
- For non-consumers, interest equal to the interest rate applied by the European Central Bank to its most recent refinancing operation plus 10 percentage points, in addition to a fixed indemnity for collection costs of 40 euros per invoice paid late.
- For consumers, interest at the legal rate for private individuals.

ARTICLE 8: CARRIERS AND DELIVERY TIMES
Livraison standard France métropolitaine :
La participation aux frais d’envoi dépend du montant total de la commande et du mode de paiement. Les frais de livraison à régler par le client sont indiqués avant validation de la commande.
GEODIS
– Les délais de livraison habituellement constatés sont de 2-4 jours ouvrés (hors jours fériés).
– Vous recevez un nouveau mail et/ou SMS quand le colis arrive sur le site de distribution.
– Si vous êtes absent lors de la livraison, un avis de passage est déposé dans votre boîte aux lettres. Vous disposez de 8 jours pour prévenir le transporteur d’un nouveau passage.
Il vous appartient, en cas de retard, avarie ou manquant, de formuler toute réserve précise et circonstanciée dans les trois jours suivants la réception, en vertu de l’article L. 133-3 du Code de commerce. Le client en avertira ecocréation.com dans le même délai.
ARTICLE 10: WITHDRAWAL FOR CONSUMER CUSTOMERS
Withdrawal period
In accordance with article L.221-18 of the Consumer Code, the consumer customer has a period of 14 days from receipt of the product in which to exercise his right of withdrawal, either himself or through a designated third party (other than the carrier).
If this period expires on a Saturday, Sunday or public holiday, it is extended until the next working day. In the case of an order for several products delivered separately, the withdrawal period begins from receipt of the last item.
In accordance with article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to goods manufactured to the customer’s specifications or personalised.
Exercising the right of withdrawal
To retract, the customer must inform Eco Creation of their decision before the end of the deadline, by means of a clear statement (letter, e-mail or fax). They may use the withdrawal form provided, but this is not obligatory.

The cost of returning the product is borne by the customer and is estimated at €200.
Refunds
Eco Creation will refund all sums paid within 14 days of receipt of the returned product or proof of dispatch. The refund will be made via the same means of payment used at the time of purchase, unless otherwise agreed with the customer, at no additional cost.
Condition of the returned product
The product must be returned in its original condition and packaging, with all accessories, following the return instructions provided by Eco Creation.
ARTICLE 11: LEGAL GUARANTEES
Legal guarantee of conformity
When a customer invokes the legal guarantee of conformity, they :
- Has 2 years from delivery of the product to take action;
- May opt to repair or replace the product, subject to the cost conditions defined in article L.217-19 of the French Consumer Code;
- Does not have to prove the existence of the lack of conformity during the 24 months following delivery.
This guarantee applies independently of any commercial guarantee that may be offered.
Legal guarantee against hidden defects
The customer may also make use of the legal guarantee against hidden product defects, in accordance with article 1641 of the French Civil Code. In this case, the customer may choose between :
- Cancellation of the sale,
- A reduction in the purchase price, in accordance with article 1644 of the French Civil Code.
ARTICLE 12: PROVISIONS OF THE ‘INFORMATION TECHNOLOGY AND CIVIL LIBERTIES’ ACT
The personal information collected is used exclusively to manage orders and issue invoices. The following data is collected with the consent of the customer or their representative, for contractual purposes: title, surname, first name, postal and e-mail address, telephone number.
This information is mandatory for processing the order. Failure to do so will result in the order not being processed. The data will be kept for 10 years from the date of the order and will not be transferred outside the European Union or communicated to third parties, with the exception of the carrier.
In accordance with the French Data Protection Act, customers may exercise their rights of access, rectification, deletion, limitation of processing, opposition and portability of their data by contacting Eco Création by e-mail or post at the address given above. You may also file a complaint with the CNIL.
Finally, in application of article L.223-2 of the French Consumer Code, the consumer customer is informed of his right to register free of charge on a list of opposition to telephone canvassing.
ARTICLE 13: RETENTION OF TITLE CLAUSE
All products are sold with a retention of title clause, stipulating that ownership is not transferred to the customer until full payment has been received.
However, this reservation of ownership does not affect the transfer of risks, which is the responsibility of the customer upon delivery. Until ownership is transferred, the customer must ensure that the products are properly stored and that they are clearly identified.
ARTICLE 14: USE OF COOKIES
When you browse ecocreation.com, cookies are stored on your computer, mobile or tablet. These files enable us to optimise your experience by making it easier for you to identify yourself, access your account, manage your shopping basket and personalise our offers and recommendations.

ARTICLE 15: APPLICABLE LAW
Any disagreement relating to the order, in particular as regards its execution, interpretation, validity or cancellation, will be subject to French law, both as regards form and substance, to the exclusion of the provisions of the Vienna Convention of 11 April 1980 on the international sale of goods.
ARTICLE 16 : COMPETENCE JURIDICTIONNELLE
In the event of a dispute, the consumer customer should first contact Customer Services by telephone (on the number given in the preamble), Monday to Friday, from 9am to 5pm, or by e-mail (to the address given in the preamble). If no solution is found within one month of the request, the customer may refer the matter to a consumer ombudsman, who will attempt to resolve the dispute amicably, free of charge.
For business customers, any legal action relating to the conclusion, interpretation, performance or termination of this contract will fall within the exclusive jurisdiction of the Commercial Court of Nantes.
